The General Membership Meeting for the club will be Monday, October 17th at 7:00 pm.
The meeting will be held at the Livonia Civic Center Library which is located at:

There are several proposed Bylaw changes that will be voted on at the meeting.

These changes are highlighted in yellow in the document linked below.

Proposed Newburgh Swim Club Bylaws 2016

Below is a list of the sections that are proposed to be changed:

Article IV, Section 3 – “Require an annual compilation of the books by Certified Public Accountants before the end of the calendar year” (changed from “the date of the General Membership Meeting”)

Article IV, Section 5 – “Special meetings of the Board may be called by the President or their representative in their absence, at this discretion, at any time, by means of personal contact, club posting, written notice by mail, or electronic communication. . . ” (changed from written notice by mail)

Article VI, Section 10 – “The membership shall be restricted to a maximum of three hundred and fifty (350) Standard Membership certificates” (changed from three hundred and fourth (340))

Article VI, Section 11 (c) – In the event that the certificate is terminated, each spouse will receive 50% of the bond, less any applicable late fees. Unless otherwise directed by a court of law or a notarized letter, both spouses must sign the sales request before the bond can be return (NEW).

Article VI, Section 11 (d) – All terminated and cancelled memberships must return a completed sales request form, postmarked by December 31st of the year that the membership is terminated, else the membership bond will be forfeited to the Club (NEW)

Article VII, Section 1 – “An annual meeting of the members shall be held in each year of the first Monday in August” (changed from the third Monday in October)

Article VII, Section 1 – “Notice of such annual meeting shall be via electronic or written communication or posted at the club” (changed from given in writing and mailed to all members)

Article VII, Section 3 – Second Agenda Item “Reading of Meeting Announcement” (changed from Reading Notice and Proof of Mailing)

Article VII, Section 4 – “Special meetings . . . may be called . . . and not less than fifteen (15) days notice” (changed from fifteen (15) days written notice)

Article VII, Section 9 – “Notice of meetings, either annual or special, to the current contact information on record of the Club . . .” (changed from last address shown on the books of the Club)

Article VIII, Section 4 – ” . . . A seasonal maintenance fee of ($60.00) will be paid by each membership annually toward the maintenance associated with club opening and closing. (NEW).

Article VIII, Section 7 – “Each membership will be required to annually provide four adult (18 years old or older) working hours for the operation of the Club, or be assessed a Work Fee determined by the Board of Directors. Any Work Fee so assessed is to be paid with the annual dues and will be refunded by check or equivalent monetary amount of guest passes when the required working hours are completed. (This section is slate to be removed from the currently bylaws which will change the numbers if subsequent sections in the Bylaws document)

Article VIII, Section 7 – ” . . . If payment is transmitted by mail, the postmark date shall be considered the date received, and if the postmark is not dated or is not legible, it shall be presumed to be postmarked two business days before delivery. (changed from two days)

Article VIII, Section 7 (a) –  “Payments received with a postmark after April 30 will not be accepted and the membership will be cancelled. The membership bond will be refunded, minus the late fee as outlined above and the membership will be sold to the next eligible applicant. (This wording was previously part of section 7 and is now called out as a new subsection 7 (a)

Article VIII, Section 7 (b) –  “Each membership is required to annually submit either dues or a sales request postmarked by March 31.  Any sales requests postmarked after March 31 will be assessed the stated late fee, unless dues for the season have been paid, in which case they will be refunded as stated above” (NEW)

Article VIII, Section 10 – “If the registered owner of a membership certificate desires to sell or transfer his membership under any condition other than those set forth in Article VIII, Section 8, they must first offer said membership to the Club in return for a refund to the member of the original membership fee paid for such membership at the time of its original issuance to the registered owner. (changed from Article VIII, Section 10)
